Malpractice lawsuit against Parkhill, doctors dismissed

A malpractice lawsuit filed last year against Parkhill Clinic for Women and two doctors has been dismissed without prejudice and will likely be refiled within a year.

The lawsuit filed by Mark William Bokermann on behalf of his late wife, Leah Anne Bokermann, had been scheduled for a 10-day jury trial beginning Nov. 12 before 4 th Judicial Circuit Judge Mark Lindsay.

The Bokermann lawsuit filed against Parkhill, Dr. Paige Partridge and Dr. Robert Hix. The plaintiff sought damages for the death of Leah Anne Bokermann, who died Aug. 13, 2005, after apparently suffering complications following the birth of a child on July 31.

“ There was no settlement, and we do not expect there to be, ” said Walter Cox, attorney for the defendants.

The plaintiff’s attorney, Tab Turner, said the case was dismissed without prejudice to be refiled due to a late witness issue.

“ There are deadlines that have to be met, and an important late witness came into the picture with certain opinions about the cause of death from an autopsy. And we nonsuited the case so that the witness could be timely disclosed and thus be permitted to testify at trial, ” Turner said.
