Malpractice suit filed against surgeon, clinics

A malpractice lawsuit was filed Thursday against The Center for Health Care and Dr. J. Russell Davis by a patient who suffered infection and complications from surgery in 2006.
The suit also names as defendants the Highlands Oncology Group, Cardiovascular Surgery Center of Northwest Arkansas and a “ John Doe, ” an unidentified nurse who assisted Davis.
The plaintiff, Donnie Mayo, claims in the lawsuit that he underwent a medical procedure on July 31, 2006, where a portion of his esophagus was excised and a feeding tube was inserted into his stomach by Davis.
During a separate visit on Aug. 29, 2006, Mayo’s feeding tube was removed by the unnamed nurse under the direction of Davis.
During the removal, a Dacron cuff that anchored the feeding tube was left inside the body after closure of the surgical site, according to the complaint.
As a result of this foreign object inside his body, Mayo suffered infections and complications until Aug. 22, 2007, when the cuff was surgically removed, the suit alleges.
Mayo claims he would not have elected to retain the cuff if he had been informed of the potential risks and alternatives.
Mayo is seeking to recover medical bills he incurred and damages for pain and suffering.
A spokesman for Highlands Oncology would not comment on the lawsuit.
