Greenland’s lawsuit against developer moving forward

Fingers are pointing in the city of Greenland’s lawsuit against Willie Mooney and Brothers Construction Inc., both of Van Buren. Brothers Construction filed crossclaims against Mooney and is petitioning the judge to allow it to sue a silent business partner of Mooney.

The situation started in early October when the City Council voted to sue Mooney and Brothers Construction because city engineers claim the developer and construction company did not hold up their end of the deal when it came to building the fourth phase of the Lee Valley Subdivision, north of Wilson Street and west of Caleb Drive.

Some of the problems with the subdivision, as documented by city engineers, include unfinished and clogged drainage ditches, incomplete storm pipes, sewer boxes without lids and loose light posts.

City Attorney Danny Wright said a court date of May 7 was set.

“ Which I don’t think will be enough time, ” he said.

Wright said a case like this will warrant a number of expert witnesses from both sides and will take more time than most cases.

“ We’ve got to have enough time to try the case, ” Wright said. “ I’d anticipate a minimum of two to four days. ”

For now, both groups remain in discovery awaiting to hear the other side’s story. Wright said the city is still waiting on the original construction plans — the ones used by Brothers Construction Inc. while building the subdivision — to see if they match the preliminary plat approved by the Planning Commission.
