Suit filed over vasectomy

BENTONVILLE - A Rogers couple are suing their medical provider over the wife's pregnancy after her husband received a vasectomy.

Bentonville attorney Michael Martz filed the suit Friday on behalf of Brady Hill and Mindy Hill. The suit names Dr. Michael F. McGehee, Northwest Health System of Arkansas, Mercy Health System of Northwest Arkansas, Garrett Goss Clinic and John Does 1-45, as defendants.

According to the complaint, on Sept. 8, 2006, McGehee performed a vasectomy on Hill. McGehee later informed Mindy Hill that her husband was sterile after tests were conducted on his semen samples.

Hill became pregnant later that year, according to court documents.

The suit claims Brady Hill returned to the clinic to discuss his wife's pregnancy, and a Mercy Health staff member questioned whether he was the biological father and cast doubts on his wife's fidelity, the suit states.

McGehee ordered another semen-sample analysis, and the testing concluded that the odds that Hill had fathered the expected child ranged between 20, 000 to 1 and 30, 000 to 1, the suit states. The suit claims McGehee also cast doubt on Mindy Hill's fidelity.

The suit alleges the comments of McGehee and the Mercy employee caused a great deal of stress on the couple's marriage, which included physical and emotional distress on Mindy Hill during the pregnancy.

Mindy Hill suffered a miscarriage in February 2007. A paternity test revealed a 99. 999 percent chance that Hill was the father, according to court documents.

The couple are suing for negligence and defamation. The suit is seeking unspecified monetary damages.

The case is assigned to Circuit Judge David Clinger.
