BENTONVILLE - The Southwest City, Mo., man accused of a murder in McDonald County, Mo., also faces felony charges in Benton County for allegedly shooting at and threatening the life of another man.
Buddy Bice, 67, charged with first degree murder, is being held in the McDonald County Jail in lieu of $ 100, 000 bond.
He is accused of shooting and killing David Surface.
Greg Sweeten, chief deputy of the McDonald County Sheriff's Office, said deputies responded to a call at 10: 45 p.m. March 16 and found Surface's body in the front yard of Bice's home.
On Nov. 28, 2007, Benton County Sheriff's Office deputies Wade Porter and Tony Rogers arrested Bice at a Sulphur Springs residence after they were dispatched to a disturbance with shots fired, according to court documents.
Bice's son-in-law, Larry Sales, told the deputies that Bice came to his home and was arguing with Sales' wife, court documents state. Sales asked Bice to leave and was walking him back to his truck when Bice pulled out a small pistol and fired one shot at Sales as he fled the area, according to an affidavit in the case. Sales went into his home and grabbed a shotgun, but he dropped the gun and was able to tackle Bice and restrain him until deputies arrived, the affidavit states.
Sales reported that Bice threatened to kill him, according to court documents.
Bice was charged with aggravated assault and terroristic threatening, both class D felonies.
He was released from the Benton County Jail after posting $ 25, 000 bond.
Deputy Prosecutor Ben Poole filed a motion Thursday seeking to suspend Bice's bond on the Benton County charges.
If Bice bonds out of the McDonald County Jail, Poole is requesting a hearing to consider the revocation of Bice's $ 25, 000 bond.
