State sues Web pharmacy on slack rules

The state attorney general’s office said Tuesday it filed a lawsuit against an Internet pharmacy for allegedly providing prescription drugs to patients who only filled out an online questionnaire.
KwikMed LLC of Scottsdale, Ariz., says on its Web site that it uses licensed physicians to evaluate patient needs. But the lawsuit by Arkansas Attorney General Dustin McDaniel alleges the company violated a state law that requires a valid doctor-patient relationship for prescriptions to be written.
McDaniel said more than 300 prescription orders were mailed to Arkansas, and his office is seeking civil penalties of $ 10, 000 per violation.
“Prescription medicine needs to be delivered to Arkansas patients in a manner that is consistent with state law,” McDaniel said in a news release. “This office will continue to go after companies who violate the state laws that were passed with the safety and best interest of Arkansans in mind.”
The Pulaski County case is before Circuit Judge Mary Mc-Gowan.
