Huckabee taps lawyer for appellate judge spot

A Helena-West Helena attorney, Brian S. Miller, became a member of the Arkansas Court of Appeals this month.

In an appointment that Gov. Mike Huckabee’s office didn’t announce, Huckabee on Dec. 15 appointed Miller to the Court of Appeals, effective Jan. 1, according to records in the secretary of state’s office.

As a result of the vacancy created by the resignation of Judge John Mauzy Pittman and under the authority of Amendments 29 and 80 to the Arkansas Constitution, Huckabee appointed Miller to represent District 7 on the appeals court, according to Huckabee’s letter to Miller.

The eight-year term for the post ends at the end of 2008, said J. D. Gingerich, director of the state’s Administrative Office of the Courts.

Pittman, who has been on the court since 1993, resigned after his election to District 1, Position 1 in the Nov. 8 general election. He’s the court’s chief judge.

Miller had been an attorney for Martin, Tate, Morrow & Marston law firm based in Memphis. He previously was city attorney for Edmondson, Helena, and Lake View, Holly Grove’s city judge, and deputy prosecuting attorney in Phillips County, according to the law firm’s Web site.

He earned his bachelor’s degree from the University of Central Arkansas in 1992 and law degree from Vanderbilt University School of Law in 1995. He served in the U. S. Navy from 1985-89.
